DALLAS , TEXAS, USA, April 30, 2019 / — Commanding prices as much as 80 percent or more higher than their counterparts, 'untreated' sapphires, as they're known, are rocketing in value. A graduate gemologist, appraiser, and auctioneer, jewelry expert Joseph DuMouchelle offers a closer look at the market for these rare, untreated gemstones.

Explaining so-called gemstone 'treatments,' Gemological Institute of America Alumni Association international board member and former head of the Accredited Gemologists Association Joseph DuMouchelle reveals that any process beyond cutting and polishing a stone for color, clarity, or durability falls into this bracket, also known as 'enhancing' gemstones.

"Treatments and enhancements are common in the gemstone market," DuMouchelle explains, "and may be carried out in order to improve the appearance or wearability and durability of a stone."

"However," he continues, "it's extremely important to consider the potential value implications prior to applying treatments or enhancements to any gemstone."

According to DuMouchelle, particularly desirable natural gems, such as sapphires, routinely command as much as a 50 percent or more premium over their enhanced counterparts. "Natural sapphires command significantly higher prices today than treated or enhanced examples," the expert reveals, "despite those which have undergone radiation exposure and heat treatments, for example, often being visually more appealing and colorful in many people's opinions."

Indeed, the International Gem Society suggests that mid-quality untreated blue sapphires will sell for approximately 30 percent more than a treated stone of equal quality. "Top quality untreated stones, though," adds DuMouchelle, "especially if they're large, have recently commanded premiums of 80 percent and above, and it's a premium which is rising."

Naturally colored sapphires get their range of hues from traces of chromium, iron, titanium, and other elements found deep underground.

Beyond heat treatments and radiation exposure, other forms of enhancement available in the industry involve dyeing, coating, fracture filling, diffusion treatments, and oiling. "Aside from oiling, all of these processes are permanent," DuMouchelle explains, wrapping up, "so it's crucial to consider the value implications before going ahead with any such process, especially when taking sapphires and other similarly rare or desirable gemstones into consideration."

NEW YORK, NEW YORK, UNITED STATES, April 30, 2019 / — Kéze Records announces the release of ShiZ’ka’s debut album Scarlatti Sonatas featuring fourteen of the renowned composer Giuseppe Domenico Scarlatti’s sonatas. Playing classical piano since the age of four, ShiZ’ka is an acknowledged Scarlatti authority who has studied with renowned Japanese teachers Toshimi Sakou, Keita Kosaka, Makoto Yamahata, and Mako Okamoto. She has also studied at prominent music schools including Doshisha Women’s College of Liberal Arts and Berklee College of Music.

ShiZ'ka comes from a family of musicians. Her parents Nobue and Toshiyuki Saeki are both classical musicians (bassoonist and oboist, respectively) and run a very successful music school, Poco A Poco, in Japan. Since ShiZ’ka was very young, she possessed a deep passion to perform. Much later, she was profoundly inspired by the nobility of Emil Gilels’ performances.

She supplemented her classical training by studying with famed jazz pianists Makoto Takenaka and Yoko Yamamoto. Her early exposure to jazz has influenced her approach towards classical music, in what some are calling an “individual sensibility to timing and rhythm, with clarity and articulation.”

When asked why Scarlatti, ShiZ’ka explains, “When I started learning the Sonatas, my hands and fingers naturally played each piece as if I had played them all my life. It was a body, mind and soul connection for me. Hearing a recording of Elaine Comparone playing the K118 on the harpsichord impressed me so much that I made it a goal to play the Sonatas on the piano as brilliantly and as gracefully as Ms Comparone did on the piece’s originally intended instrument.”

The fourteen sonatas from Scarlatti’s repertoire have been chosen by ShiZ’ka and were recorded in random order. After the recordings were completed, ShiZ’ka took an intuitive approach to organizing the order for the sonatas so the album would have an organic flow, rendering each sonata relevant to the other, while allowing each sonata to stand on its own.

ShiZ'ka now resides in New York with her two year old son Emil and her husband, Edmund Arkus. She has recently performed at the Mount Sinai Guggenheim Atrium in NYC, Third Street Music School Settlement, Tenri Cultural Institute and The National Opera Center.

New York State Officials and Supreme Court Justices Sued for Deprivation of Rights Under the Color of State Law

The City of New York, Manhattan District Attorney, Seven New York State Court Justices and other officials were sued for deprivation of rights under the color of law a civil violation under the law (42 U.S. Code § 1983) and a criminal violation under the law (18 U.S. Code § 242). The Civil Rights Complaints, Penn v. City of New York, et. al., 19-cv-02106 (under 42 U.S. Code § 1983) and Penn v. Amelia Cottrell, et. al., 19-cv-02741 (under Bivens) alleges that an indictment dated February 10, 2014 (New York Supreme Court Indictment #073/2014) and conviction of Lawrence E. Penn III, the Founder of Private Equity firm, The Camelot Group was unlawful from the very beginning. Civil Rights and Bivens actions allege that members of the Securities and Exchange Commission submitted a Complaint to the Manhattan District Attorney with false statements on January 30, 2014 resulting in an unlawful larceny-based indictment under the color of law in order to gain a civil case benefit by use of an unlawful conviction.

The lawsuits allege that the top count of larceny and the associated counts which rely on larceny are in direct violation of statutory and common law as decided by the Court of Appeals of the State of New York (the highest court in New York State) which ruled by declaratory decree over 25 years ago in long-established law in People v. Zinke, 556 N.Y.S.2d 11, 76 N.W.2d 8 (1990), that a “general partner in limited partnership cannot be found guilty of larceny for misappropriating partnership funds” because they are joint or common owners. Specifically, it is unlawful to charge a joint or common owner with interests in rights to distributions in limited partnership with larceny.


Mr. Penn, a joint and common beneficial owner with interests in rights to distributions in the limited partnership and the sole acting General Partner in the Limited Partnership called Camelot Acquisitions Secondary Opportunities, LP. Like other General Partners around the country, Mr. Penn established the Partnership, raised all the money, invested the capital, and met the contractual essence of the Partnership Agreement. The Complaints allege that the larceny-based indictment has no basis in law, was used to justify an arrest warrant and a bail of $2.5 million at arraignment as evidenced by Hearing Minutes.

The Securities and Exchange Commission acknowledges in a February 22, 2019 letter that, “From 2007 through 2014, he [Mr. Penn] was the general partner of Camelot Acquisitions Secondary Opportunities, LP (the Fund).” As part of Mr. Penn’s plea, he was required to forfeit his beneficial ownership in the partnership based on the money he put in the partnership. Obviously, you can’t forfeit something you do not own. Complaints alleges that the courts knew Mr. Penn was an owner and that his money was in the partnership.


The lawsuits allege Mr. Penn was detained in Manhattan Detention Center (MDC) for 14 months under the color of state law from February 10, 2014 to at least March 16, 2015, where a plea under the color of state law was entered. Mr. Penn states, “his plea and conviction are unconstitutionally void and invalid” because he was not informed of the law after direct inquiries to his defense attorney Benjamin Brafman. Prior to his incarceration, Mr. Penn had never been arrested, let alone detained or incarcerated. On the contrary, Mr. Penn is a former military officer who served honorably in the U.S. Army after graduation from the United States Military Academy at West Point with 3 masters’ degrees to include a Columbia MBA, executive education from Harvard, Peking, Oxford and Dartmouth, as well as 20 years of professional management, executive experience in private equity, mergers and acquisitions, and community leadership. He was one of the pioneer private equity secondary market.


Lawsuits allege that Appellate Division First Department’s ruling defies the record, facts, law and logic. as implied by. “Here, it is undisputed that Mr. Penn was the sole owner…of the ownership interest in the limited partnership. As such, Mr. Penn's conviction of larceny should be vacated, just as the defendant in Zinke's conviction of larceny was vacated by this Court.”


The Complaints allege that both state and federal judges must uphold New York State law and declaratory decrees and that Federal Judges reliance on an unlawful conviction “on its face” is unconstitutional. Letters referring the cases to several federal and state officials were sent out to New York State legislators, Chief Judge Colleen McMahon of SDNY, U.S. Congressman Hakeem Jeffries of the Judiciary Committee, Department of Justice Civil Rights Division and President Trump.

The lawsuits bring to light unequal treatment of African-American litigants, wrongful convictions of U.S. veterans who honorably serve, the shortcomings of state level plea deals, unfair treatment of those who defend themselves, deprivations of immunities and privileges under long-established law as well as questions as to when immunity falls for state and federal prosecutorial and judicial officials.

“Can you share your “5 Things I Wish Someone Told Me Before I Started Leading a Cannabis Business”? Please share a story or example for each.

Be prepared to be persistent. Although we are an ancillary cannabis business, we are still considered to be in the business of cannabis. It was incredibly difficult to onboard a payment processor to do payouts for our professionals on Mary’s List. We went through 15 different payment processors before finally finding a company that would allow us to do payouts. We were met with the same hurdles that any plant-touching business would go through getting a payment processor, which is a lot. We kept believing there was an option out there for us, and the 16th processor was our saving grace. Always be persistent.

Startup capital is important, so get some and probably get more than you think! You’re going to need money to make money, especially in the cannabis industry. It’s expensive to be at events, set up your business, work with and hire the right partners to grow — the day-to-day adds up so be prepared because it could be a while before you start turning a profit.

The stigma is ALIVE AND REAL. Even though you could be building an ancillary company in the cannabis industry, you’re still in cannabis. There are people out there that don’t approve of cannabis as individuals or as businesses. For example, when we were in Las Vegas for MJ Biz Con, we needed to get something printed last minute. I had a company flat-out tell me that they refused to do any printing for me because I was involved in cannabis. I am constantly surrounded by dogs so there is never a dull moment. But I’d have to say that having a senior vice president of a major drug chain, as well as the pet buyers from a major brick-and-mortar and online retailer call ME to ask how to sell CBD, how CBD works, and if it is legal, is the most interesting thing to happen yet. Both companies called me around the same time, and I was humbled that they would seek me out for advice, and excited that we had shown big chains how important CBD is.” commented Angela Ardolino.

“Can you share the most interesting story that happened to you since you began leading your company?

When the industry was new, and we were the only facility in operation, there was interest from media in having a look around. During one visit, a journalist reached into her pocket to reveal some “product” she has purchased the day before at an illegal dispensary (for media research!) to investigate its quality and similarity to our cannabis. This was a huge problem for two reasons: 1) All cannabis in my facility was properly recorded and located — this was extraneous and could have led to a serious inventory issue and, while unlikely, a license suspension; and, 2) Contamination is the biggest concern in a cannabis facility and pollutants of any kind (especially on “dope”) could jeopardize an entire operation. Note to self: beyond hairnets and shoe covers, ask people if they have dope in their pockets before you let them in to your facility!” – Hamish Sutherland

1) Takeaways of insight from the Bloomberg BNN interview of the CEO:
dynaCERT IS NOW GROWING GOLBALY: in North America, Europe, Middle East, and India — dynaCERT has transport trucks and buses currently running in India with the government running a pilot project.

EMISSIONS REDUCTION TECHNOLOGY: The HG technology is proven through the German Government to reduce NOx by 88%, across the board dynaCERT is reducing pollutants on average north of 50%. The HG technology acts as a catalyst; hydrogen has a 9 to 10 times flame spread which helps the engine burn diesel more completely, resulting in more power, less carbon fouling, and a reduction in pollutants.

TECHNOLOGY THAT PAYS FOR ITSELF: The HG technology improves fuel economy on average 10% – 15%. Typically the HG unit costs just over $8,000 to the end user for a transport truck, resulting in a typical payback period of less than one year from fuel savings alone.

NEW EXPANSION INTO MINING INDUSTRY, HEAVY MACHINERY, POWER GENERATION, and BUSSES: dynaCERT makes HG units of various sizes tailored for unique specifications. dynaCERT just launched into the mining industry; two major mining companies have placed orders for units for their large diesel trucks, and dynaCERT has recently signed a deal with an OEM that manufactures underground mining equipment and whose primary focus is to reduce emissions. Although the initial focus has been transport trucks, dynaCERT is also now involved in making HG units for heavy equipment, and power generation; dynaCERT has HG units running in big power plants in Northern Quebec, and Saudi Arabia. dynaCERT is servicing two major bus companies in India that are provincially owned.

EUROPE'S THIRST FOR EMISSION SOLUTIONS: dynaCERT has spent over a year having its product tested, verified, and certified through TUV North and TUV South in Germany. dynaCERT is now waiting for the final stamp of approval from KBA. dynaCERT has pilot projects on right now with the government of Austria where they are running equipment and have received a commitment that upon just emission reductions they are committed to outfitting their entire fleets.

CARBON CREDIT MONETIZATION: The HG technology is unique to dynaCERT and protected by various patents, the system is fully computerized and is able to monitor and monetize carbon credits. dynaCERT is in the process of getting certified for carbon credits through the UK. CEO, Jim Payne, stated "It's taken us 15 years and $40 million years to get here. It certainly has not been an easy feat."

dynaCERT AT THE BEGINING OF MAJOR GROWTH CURVE TRAJECTORY: At the close of the interview the BNN host noted dynaCERT was publicly traded and asked "are you profitable at this point?", to which the CEO stated "Currently, we are not, like I said; we have just gone into sales, we certainly expect that by later this year we will start turning a profit".

John O'Bireck understands hydrogen enhanced combustion technology on a technical level very well. John has purchased 10 of dynaCERT's units for his own fleet. He is able to quantify the results under constant variables (e.g. same route, same driver, same load), and the HG technology comes with greenhouse gas tracking software. By using both synthetic fuels and dynaCERT's HG Technology he anticipates a reduction of greenhouse gasses from his 10 vehicles to total ~700 tonnes annually.

NEW YORK , NEW YORK, USA, April 29, 2019 / — HASA, or the HIV/AIDS Services Administration, is a New York City initiative established in 1985 in recognition of the additional or special needs of individuals living with HIV/AIDS, particularly in regards to accessing and maintaining their government benefits. A supporter of the organization and its work for more than two decades, property investors and real estate professional Barry Hers reveals more about HASA's processes and the additional benefits of its ever-growing roster of programs.

"Since its inception, HASA has had several names," explains Hers, whose offices are based in Brooklyn, "including the Division of AIDS Services and the Division of AIDS Services and Income Support."

Exclusive to New York City residents, HASA's full benefits package includes intensive case management, housing assistance, and nutrition and transportation allowances. "In the wider state of New York as a whole," adds Hers, "eligible beneficiaries are entitled to apply for certain, more limited benefits, including enhanced rent allowance, although the full HASA package is only available in New York City itself."

Currently, the program is administered by the New York City Human Resources Administration. "Many HASA recipients in New York City are eligible for the program's full array of benefits," Hers explains, "although other individuals may apply for many of the same benefits on an individual basis, including Medicaid and SNAP, for example."

"Within HASA, funding for these benefits remains the same as for any other eligible individual living in the United States," Hers continues, "although for benefits which are specific to HASA and its programs, New York City funds are used exclusively."

To seek full HASA benefits, applicants must be a resident of New York City. They may also be required to meet further eligibility criteria surrounding citizenship and their financial situation, for example, according to Barry Hers. "All applicants deemed eligible for HASA must also submit medical verification of their HIV/AIDS diagnosis," he adds, "and cooperate fully with finger imaging and various other requirements."

The New York City Human Resources Administration authorizes each HASA case for a total of 12 months. Once this period has ended, it's necessary to resubmit for the program, in order to ensure that eligibility requirements remain met.

Further to the benefits outlined above, successful HASA applicants are also granted access to mental health and substance abuse screening, treatment referrals, and employment and vocational services. "Additional benefits under HASA," Barry Hers adds, wrapping up, "also include scatter site and congregate housing, and the Housing Opportunities for Persons with AIDS program."
